How to file an application For Trademark Registration?

You can file an online application for Trademark Registration in Pakistan to protect your brand name, logo, etc. from infringement by another person under Intellectual Property Organization Pakistan (IPO) Law. Application for registration of a trademark shall be made with IPO on Form TM-A setting forth the details such as applicant’s personal details i.e., name/firm name, address, and description of goods/services along with fee set out in the Schedule “F”. The office of the Registrar of Trademarks, a government agency responsible for the registration of trademarks in Pakistan and for the administration of the Trademarks Ordinance, 2001 (‘Ordinance’), is based in Islamabad. 

The Trademarks Ordinance confers power on the Government to appoint a Registrar of trademarks from amongst persons having experience in legal matters relating to intellectual property rights, including patents, copyrights, and trademarks.

The registration system under the Ordinance is modeled on that existing in Pakistan.

The first step in trademark registration is to file an application with the Intellectual Property Organization of Pakistan, a regulatory body established in 2005. The IPO-P is a non-profit organization responsible for Patent and Trademark Registration. It is a member of the World Intellectual Property Organization (WIPO) and works closely with the International Trademark Association (INTA).

Application For Trademark Registration & Examination

Once the trademark application is filed, it takes approximately four months for the application to be examined and processed. Once the examiner has completed his examination of the trademark application, an examiner’s report is issued, which may include a request for clarifications or amendments in respect of your trademark application. Your application may also be refused if it is similar to a previously registered mark or any mark that is pending registration. 

If your trademark application is rejected, you can appeal against such rejection as per IP laws in Pakistan within three months from the date of order/rejection by filing a written notice before the Registrar’s office with requisite documents and fee payment. Once accepted for registration, you will receive a Certificate with a seal of TM within 30 days from the acceptance date.The Trademark Registration procedure can be done online, where all information regarding trademark protection, rights, and benefits are provided on IPO Pakistan Website (https://www.ipo.gov.pk).

Publication in Journal & Opposition

  • Rejection of the application. A rejection may be issued if the mark fails to meet at least one of the requirements discussed above, or in case of opposition by a third party.
  • Approval and publication in the Trademark Journal. If no objections arise, an approval order will be issued and published in the journal. The publication period is 4 months from the date of publication, wherein any person can file an opposition against trademark registration under section 23 (1) (a) within those 4 months from the date of journal publication.
  • Opposition proceedings. Upon filing an opposition, a notice will be sent to both parties i.e. opponent and applicant for a hearing before the Registrar of Trademarks on a fixed date as per provisions contained under Section 23 (2) (b). It is also worth noting that once the opposition is filed, there would be no further hearing before the Registrar unless upon request by either party or unless such a decision has been given by the Court after an appeal made against any decision of the Registrar due to which trademark application did not proceed further. In case no objection arises during the publication period then this status remains pending until the final Registration Certificate is issued which proceeds on a first-come, first-served basis subject to the issuance of the final registration certificate depending on the number of applications pending final examination before Registry department as per section 25 & 26 of Trademark Ordinance 2001

This certificate will show the date that the trademark was filed in Pakistan, the class it is registered under, the term of registration (10 years), and when it was registered.
